Credit Terms

Strictly net 30 days for approved accounts. Accounts in excess of our trading terms will automatically be placed on stop supply. The purchaser agrees to pay all costs including legal costs on a solicitor/client basis. The purchaser further agress to pay interest on outstanding accounts at the rate which is 2% above the rate charged by St.George Bank Limited for overdrafts under $50,000.00.

Title of Goods

The purchaser agrees that Airco Fasteners Pty Ltd will retain ownership of the goods until full payment has been made, notwithstanding any “on sale” by the purchaser. The purchaser acknowledges that Airco Fasteners Pty Ltd, its servants or agents shall not be liable in trespass in entering any property to retrieve the goods.

Delivery

(a) A freight charge of $10.00 plus GST will apply to all orders in Sydney, Melbourne, Brisbane, Adelaide and Perth metropolitan areas. For country orders (NSW, VIC, QLD, SA, WA) – Freight payable from nearest capital city plus GST. For TAS, NT orders – freight chargeable less 30% discount plus GST.

(b) A minimum order value of $150.00 will apply to all orders except spare parts.

(c) Airco will not be liable for any consequential losses or damages resulting from any delay or inability to ship or deliver goods ordered for any cause whatsoever.

(d) Airco reserves the right to round off ordering quantities within a 5% variance to deliver full cartons where possible.

(e) Back Orders – We reserve the right to request an increase should the value of the back order be under $150.00.

Warranty

All fasteners are warranted to be free from defects in materials and workmanship. Normal care must be utilised in handling and storage of fasteners. We do not guarantee nor warrant galvanised product against corrosion.

All tools carry a minimum three month warranty (Airco Air Tools carry a 12 month warranty) on all parts with the exception of Driver Blades, Bumpers and O-Rings. Components found to be defective in workmanship or materials within the warranty period will be replaced at no charge. Warranty will be void if the tool has been misused, deliberately damaged or fasteners other than genuine Airco product have been used. (Please note the cost of transportation to or from Airco Fasteners Pty Ltd or its nominated agent is not covered by this warranty).

Claims

Will not be recognised unless made in writing within 5 days of delivery.

The Laws of NSW shall apply and the Courts of NSW shall have sole jurisdiction in relation to any dispute arising between the parties.

Returns

(a) will not be accepted unless prior approval has been obtained in writing from seller and Airco approved
return number quoted.

(b) All freight costs must be pre-paid by the buyer.

(c) “Specials” Indent Orders and “buy-ins” are non-returnable.

(d) Returned Goods are subject to a 15% restocking fee, plus any costs incurred in repacking.

Limitation of Liability

Airco Fasteners Pty Ltd:

(a) will not be liable for any loss or damages suffered (whether direct, indirect or consequential) arising in any way out of any defective goods, or any negligent act or omission of Airco Fasteners Pty Ltd, its officers, employees, contractors or agents, including but not limited to loss of profits and damage sustained or incurred as a result of a claim by a third party; and

(b) gives no warranties whether express or implied except those which are implied by statute and which cannot be excluded.

It is the purchaser's responsibility to ensure at all times that tools and fasteners purchased
are appropriate to the particular purpose.
